Liability in Work Place

...are in play. Include in your memo any laws which apply and any precedential cases either for or against Teddy's case which impact liability. Include in the memo your suggested "offer of settlement" to Virginia. Back up your offer using your analysis of the case against Teddy's Dear Mr. Moore, After an independent study and review of this case, it is my judgment that Teddy's Supplies is indeed liable for workplace and sexual harassment against Virginia Pollard. A careful review of the case also indicates that the plaintiff, Ms. Pollard, was placed in a "hostile" environment under the supervision of Steve King. While it is not illegal for one woman to work among a group of men, careful judgment should be used by the employer in determining if the work environment is suitable for males and females. As a general rule, it is not good practice to have one female working with all male colleagues. First of all, I will define these three types of sexual harassment as stated by: http://www.strategichr.com/shrsweb2/harassment_01.shtml a) “Workplace harassment is any unwelcome or unwanted conduct that denigrates or shows hostility or an aversion toward another person on the basis of any characteristic protected by law, which includes an individual's race, color, gender, ethnic or national origin, age, religion, disability, marital status, sexual orientation, gender identity, or other personal characteristic protected by law. Work Place Ethical Dilemma

...Work Place Ethical Dilemma Marinda Thomas BSHS/332 May 27, 2013 Mrs. Marcia Winter Work Place Ethical Dilemma In this paper I will discuss various points on ethical dilemmas within the work place. I will also talk about how these dilemmas intersect with my own personal values. Throughout this paper I will also offer reasons to why I should solve the dilemma as well as a resolution of sorts. “Ethics as a discipline, refers to both the study of our values and their justification, the actual values and standards of conduct by which we live” (Freeman, 2000, p. 31). “Ethical dilemma is a complex situation that will involve conflicts between moral imperatives” (Freeman, 2000). The Dilemma Ethical dilemmas are what happen when a person is faced with a decision that may press against their personal values or beliefs. At one of my previous jobs, there was a problem with employees conducting their personal business, errands, or hobbies all while on the company’s time. This began to be a problem because while people are doing these things on company time, they are not doing the job that they are being paid to perform. Of course it may seem harmless at the time, a person finishes their projects so they use a little time here and there to do a few things that may help to pass the time and get them through their long work day, but it can become a big problem, especially when everyone begins to think that it is okay to begin doing this.  When being hired by an employer,......

The Work Place

...Running head: THE WORK ENVIROMENT 1 The Work Environment Arthur Stevens Eng. /120 December 12, 2013 Carole Miller The Work Environment I really enjoyed reading and gained a lot of insight from the article Image of Social Workers in Fiction written by Beverly B. Nichols. After reading this article I am able to take away several lessons from it. The first lesson and insight I gained from reading this article was the bias and opinions that we as a society place on individuals based on their profession. I had never sat back and thought before reading this article that I personal feel that people should think and act a certain way because they work a particular job. For example; I feel that all nurses should be nice and sweet because most of the time they are dealing with sick individuals but that is not always the case. I also feel that waitress and bartenders should be very sociable and nice because they are dealing with the pubic but I have also found that is not always the case. Just like all professions the article placed a biased on social workers because they are perceived to have an impact based on amount of control they can have on the lives of others. However, social workers view themselves as regular individuals and wish people would view them as they view themselves; just regular individuals who work every day to make ends meet and are just trying to do their job to the best of their ability. As a licensed barber I have similarities...

Absenteeism in the Place of Work

...- ABSENTEEISM IN THE WORKPLACE One of the most common problems facing employers in today’s workplace is employee absenteeism. It is not something that is unique to any particular industry as its costs impacts just about every workplace. This article is a manager’s perspective on the pervasive trend of absenteeism and why it is a huge problem. However, there are increasingly more and more ways to deal with it and help reduce its enormous costs. Absenteeism as the term suggests, is simply a matter of employees not showing up for their scheduled work. The effects of absenteeism in the workplace are also directly proportional to decreased productivity. Unabated, this can also result in the company incurring additional costs to cover for the hiring of temporary staff or paying overtime. A simple breakdown of the actual cost ramifications of absenteeism are: • Lost productivity of the absent employee • Overtime for other employees to fill in. • The costs incurred hiring temporary help. • Possible loss of business and/or dissatisfied customers. • Problems associated with lowered employee morale. • A substantial decrease in overall productivity. Productivity lost as a direct result of absenteeism is nothing to sneeze at. In the United States, the annual cost to employers for time lost due to accidents and/or unscheduled employee absences is estimated to be in the $100 billion. That figure for the Canadian workplace is estimated to be in the $15 billion range.......

...from the non-work related needs of the individual. Furthermore, if companies are insensitive to employee needs, and work becomes a significant source of stress, not only does worker productivity lessen but that company’s name and reputation as an employer may hinder its own ability attract necessary quality employees. Employees and employers alike are looking for ways to increase worker satisfaction. One increasingly attractive solution is the growing acceptance of a flexible work week and schedule. Prominent employers like Kraft Foods, Texas Instruments and First Tennessee Bank have implemented these changes for their workers to boost productivity while increasing job satisfaction (Forbes). Employers are also using these flex schedules as a way of attracting and retaining their employees. For example, “In 1999 only 18 companies on Fortune magazine’s list of Best Places to Work offered telecommuting. Today, 79 do (ABC News).” The definition of flexibility encompasses a wide range of topics such as: • Flextime (compressed work weeks and shift flexibility) • Telecommuting • Paid Time Off (personal days and vacation by the hour) “Business leaders are learning how to position flexibility as a powerful management tool used to accomplish work more efficiently, while caring about the needs of employees and bringing strategic value to the organization (US Dept of Labor)”. Several options which are being used today include a shortened work week and......

Health and Safety in the Work Place

...will be reviewing systems, policies and procedure that the new directors need to implement to ensure that health and safety information is properly communicated in health and social care setting according to the legislative requirements. I will also be assessing the responsibilities for managing the health and safety of individuals. Health and safety communication is essential when working in health and social care as a health care provider because it is your job to make your service users feel safe and comfortable, when working in a health and social care environment it is the employers job to make sure all the employees are well trained, most health care settings provide a training course at the beginning of the employment. Health as safety is often communicated through signs and posters; there are many different types of health and safety signs that can be located on doors and walls all over the building. A main example of health and safety signs is an ‘Exit’ or an ‘Emergency Exit’ sign that is usually located above a door; this sign shows us where we can exit from in case of an emergency of fire, another word for this door is a ‘Fire Escape’. Having an emergency exit sign is very important because if there happens to ever be a fire or another form of emergency it will make it quick and easy for individuals to find the quickest exit and leave safely. In a health and social care environment there are rules and codes of conduct put in place for both the staff and the...

Some forms of workplace deviance includes absenteeism, abusing sick day privileges, abusing drugs and alcohol, filing fake accident claims, sabotaging, breaking organizations’ rules, withholding effort, stealing, taking long breaks, working slowly, harassing other employees and hiding needed resources. Communication in the Work Place

...Trying to convey a message in the work place could be complicated, because you have different cultures and so that meant everyone didn’t understand or got a different meaning of the message that management was trying to get across. I am referring to when I worked for one of the suppliers of the big three AAM (American Axle &Manufacturing) the big three had an agreement with UAW to practice a fair days pay for a fair days work. Most of the time the workers didn’t want to follows those rules or they would put their own understanding on what they wanted or what was best for them. In order for the people to work and have fair representation we would need the UAW to help the workers understand what was going on when management was not being fair and letting us know of our rights as workers. They would help us understand and help us communicate our message that we wanted to get across. Being the only female job setter on my shift made it hard for me to talk with supervisors who were all men, I was always questioned on my decision making, one incident I was not trained on how to repair one particular machine and my supervisor was going to write me because I refused to work on the machine after it was said and done I had to call my committed person out in order for me not to get written up. Woman in the plant still gets the worst treatment because you still have men that don’t believe woman should be working in the plant or working at all. Even with some of the workers......

Managing Conflict in the Work Place

...Office romance is dependent on a number of factors. Office romance can have both positive and negative effects on the working environment as well as work performance. It can cause conflict in the workplace, especially if it is a supervisor-subordinate relationship. It can affect the productivity of employees and may lead to sexual harassment and other claims. It can make co-workers uncomfortable and it can be dangerous because it can lead to conflict within the organization. Accusations of favoritism may occur and it may hinder the work performance of the parties involved as well as the co-workers. After analyzing the office romance that took place within the organization and the impact on which it had on employees, the recommended course of action to resolve the actual conflict that will make a difference to the future performance of the organization is to educate the employees on the issue of office romance. Develop a policy that declares what managers expect when it comes to office romance. The parties that are involved give them options such as disclosing the relationship to their boss and deciding who will leave the job if it gets too tough to handle and the parties do not want to terminate the relationship. Explain to them the actions that management will take if they do not solve the issue themselves. Enforce the rules on sexual harassment and office romance. Although, management cannot prohibit office romance, there are steps that they can take to ensure that it......

...class status”, and poor neighborhoods. They may even think of sub cultural conflict, or conflict overseas. Then when asked what causes violence, the average American may consider poverty, racial disparity, ineffective families, substance abuse, and the list goes on. In most cases the average American maybe right, in their estimate of crime and violence. However, we tend to avoid or exclude the issue of crime and violence in the workplace. Workplace violence has become an issue that should be well thought-out, as a major concern or problem, and a contributing force to the overall violence.
