Mathis, Inc. is a designer and manufacturer of women’s clothing and specializes in high-end women’s winter fashions. Normandale, a retailer, sells high-end products in malls throughout the country. With Mathis’s high costs, Normandale is unable to make a profit from the sale of Mathis’s products.
Countess Lori-Ann (CLA) is a Mathis competitor. Normandale sends photographs and samples of the Mathis line to CLA and instructs them to make an identical line at a lower price. Mathis labels are easily discernable in the photographs and the samples have the Mathis label attached. CLA copies the Mathis line for Normandale.
CLA sells the clothing to Normandale at a low price allowing Normandale to sell the products for a total gross profit of nearly $3 million, an increase of nearly 50% over its sale of Mathis products. Mathis discovers that Normandale is selling counterfeit products, and sends several cease-and-desist letters to them—to no avail. Mathis then sues Normandale alleging Normandale has engaged in illegal conduct. Normandale counters that it did nothing wrong.
Research business law in regard to protection of intellectual property, using your textbook, the Argosy University online library resources, and the Internet. Based on the facts of the case and research, write an analytical paper. In the paper, respond to the following questions:
• Was it ethical for Normandale to sell the alleged knock-off products at a lower price? Explain.
• What federal or state laws protect owners of intellectual property? How do they apply here? Explain.
• What damages, if any, has Mathis suffered because of Normandale’s conduct? Explain.

Legal & Ethical Implications for Classroom Management

...Legal and Ethical Implications for Classroom Management Grand Canyon University- EDU 450 October 12, 2013 As teacher we have legal and ethical right when it comes to classroom management. Students and teachers have a right to learn and teach in a stress free classroom that is not going to cause harm to themselves and others. Within this paper I will discuss four articles that address the legal and ethical implications for classroom management related to the rights and responsibilities of students, teacher, and parents. The first article I read and will discuss is the Rights and Responsibilities of the Teacher and Student by Sarah Ganly. The article talked about the responsibility of the educator in the classroom and the legal rights of the students. The author addresses the liability teachers have and how they are held accountable to a certain degree. For instance, the law states that a teacher is held liable/accountable for a student’s welfare if foreseeable of harm exists (Ganly, 2007). When parents send their children to school as teacher we know students safety is top priority and better known as a legal right for the child. In the same sense parents have the right to enroll their child into a school or program that has their child best interest in mind and make it a priority. Needless to say not everyone is going to always agree on what is unforeseeable and foreseeable incident the same. When incidents occur in the classroom it should looked over......

Assignment 1 Ethical Issues in Information

...Assignment 1: Ethical Issues in Information Systems Antheus Bowden CIS109 – Intro Mgt. Info Systems Professor Arend Clayborn November 21, 2015 Ethics issues in information systems is the subject of this research paper, and if I was to choose one particular issue that interested me the most, it would be Privacy. It personally affected me in the workplace, so this paper will illustrate what I know firsthand. I’ll identify some human and technological protective measures I would use as security safeguards and enforcement actions in order to address the Privacy issue, list some problems related to management information systems that may arise from this issue, and propose at least one solution to address the problem in question. Privacy is the right of individuals to retain certain information about them without disclosure and to have any information collected about them with their consent protected against unauthorized access. In the workplace unfortunately, what we consider private could potentially be the reason for our employment or even our termination. Employers have monitoring systems that can measure performance and determine time spent at desk, and organizations, institutions, and firms can gather personal information and enter it into databases for their personal gain. One protective measure to safeguard my privacy would be to use a “private browsing mode”. That limits the web history kept on the computer, which will prevent others from accessing......

Legal 500- Assignment 1

...1. Explain if it matters that a parent literally had nothing to do with a biological child in order for the child to take advantage of the Family and Medical Leave Act (FMLA) to care for that parent. The employees can reasonably expect privacy in the workplace in places like restrooms, parking lots, lounges and in the kitchen area. But generally speaking it is really difficult these days to have complete privacy. 2- Explain whether the size of the business can have any effect on whether Tony is eligible for family leave under the FMLA. It makes a difference if employee is in an open area or in an enclosed office and courts have so held. See, for example, United States v. Lefkowitz, 464 F.Supp. 227 (C.D.Cal. 1979), aff'd, 618 F.2d 1313 (9th Cir. 1980) “Outside his or her own workspace, a corporate officer or employee has a reasonable expectation of privacy to challenge a search if he or she has a "possessory or proprietary interest" in the area searched and there is a connection between this area and his or her own workspace”. Both open area work spaces and enclosed private offices have their own benefits. Open space allows for better communication and exchange for information among co-workers. It is much easier to ask each other questions in an open environment. While on the other hand 90 percent of the participants reported that privacy is the number one benefit of a closed space environment. Employees feel more secure and reduced noise (O’Neill, 2008). After the......

Legal 100 Assignment 1

...future will be women that qualify for the job. Management could have solved this problem prior to it becoming a problem. I am quite positive that they knew exactly what they were doing and that they were discriminating. Seven years is a long time, not to consider what they were doing to be well known. Risk management could have had a crucial role to play in this lawsuit due to the fact that if Wal-Mart had used risk management properly they would have not come to this type of conclusion ending in a lawsuit costing millions. “Identify risks, frequency of exposure to risks, and the seventy of losses resulting from exposure to risks: to do this, organizations use data on the history of organizational loss including past lawsuits, complaints, and payouts resulting from liability claims.” (Policing, 2005) If Wal-Mart’s management had used risk management to at the very least examine the complaints that were coming in from women, they would have been able to see their error and would have had ample time to fix it before it came to a lawsuit. Determining the position’s qualifying needs by stating that a woman cannot do the work is not only discriminating but is also unethical. Management could have prevented this lawsuit from happening by not only taking the time to listen but they could have also examined the employee files at some point during the seven years, and they would have noticed that nothing but males were being hired. The ethical considerations that are reflected in......
